The Contract for Service

 

Registered and licensed counsellors(s) by the Board of Counsellors Malaysia (hereinafter referred to as the “counsellor”) are practicing under The Wisdom Waves owned by Forbearance Educare Sdn. Bhd. Therefore the contract for service is between The Wisdom Waves and you (hereinafter referred to as the “client”). Administrative charges are to be addressed to Forbearance Educare Sdn. Bhd.

About Therapy

 

The Wisdom Waves holds the philosophy that the client knows best of his/her story and life experiences. The counsellor takes on the role as the supporting agent to provide clarity and guidance to the client without judgment, personal opinions, or ready-made solutions.

The therapeutic alliance is a collaborative partnership where the client is the primary authority while the counsellor provides techniques and insights to assist with the process and navigation of the client’s life journey. The effectiveness of therapy progress is enhanced when the client communicates openly and honestly about their concerns and challenges. The primary goal of therapy is to empower the client to take ownership of well-considered decisions and choices. The ultimate responsibility for change rests with the client and the client holds the right and freedom to decline any suggested techniques or procedures.

Clients retain the freedom to end therapy at any point, and it is recommended to discuss the reasons for discontinuation with the counsellor before making a final decision.

Privacy and Confidentiality

 

The counsellor commits to maintaining confidentiality regarding all information acquired during the course of therapy with the client in accordance with the Malaysian Counsellor Code of Ethics enacted by the Malaysian Board of Counsellors as well as the International Counselling Association Malaysia which serve as the primary guidelines for professional behaviour of counsellors in Malaysia. However, specific exclusions to confidentiality exist, including but not limited to:

  • When the client is deemed to be a danger to themselves or others.
  • When the counsellor perceives potential child or elder abuse and/or neglect.
  • When the counsellor is legally mandated to disclose any information obtained during the course of service.

In the event any of the above exceptions apply, the counsellor in their best capacity shall inform the client of their mandatory responsibility to breach confidentiality and guide the client on the subsequent steps that can be taken.

Audio or Visual Recording

 

The counsellor may request to make audio or video recording of the counselling session(s) for the purposes of clinical supervision, clinical training, or research purposes. The recordings will only be reviewed by the trainee(s), counsellor(s) and supervisor(s) at The Wisdom Waves. However, the counsellor may only do so with the express written consent from the client. The client’s personal identification will be kept anonymous and the recordings will be erased upon termination of the counseling relationship. The client holds the right to revoke consent at any time in writing.

Appointments

 

All appointments must be scheduled in advance. To secure an appointment, full payment of the session fee is required. A confirmation email or Whatsapp after payment is made will be sent alongside a “Registration and Informed Consent Form” to the client. The client is required to complete and return the Form to The Wisdom Waves within 24 hours prior to the scheduled appointment.

All sessions will adhere to the scheduled start and end times. Extensions to the predetermined session duration may be possible based on the counsellor’s availability, with a prorated fee.

Cancellation of any appointments are non-refundable. Request for rescheduling must be made at least 48 hours in advance of the scheduled appointment. Appointment fees will be charged in full in the event of a missed appointment or a late request to reschedule. A maximum of 15-minutes grace is accepted after the scheduled time for late-arrivals. Packages purchased are non-refundable and valid for 6 months from date of purchase.

Referrals

 

Should the counsellor or client find that the client’s needs are better addressed by other mental health practitioners, the counsellor may provide appropriate referrals, with the client’s written request and consent to disclose the client’s personal information.

Legal Proceedings

 

The counsellor will not participate in legal proceedings initiated by the client (e.g., divorce or custody proceedings). However, if the counsellor is subpoenaed by the court to testify, the client is responsible for paying a fee of RM250 per hour to the counsellor. This fee covers both preparation time and time spent testifying, including any depositions.

Limits of Services

 

The counsellor may find it necessary to refrain from providing therapy or decline further therapy to an individual in the following circumstances:

  • Clinical considerations, such as situations beyond the counsellor’s effective capacity to help.
  • Ethical considerations, including issues related to dual relationships or inappropriate conduct.
  • Involvement in legal proceedings, such as court-ordered therapy, forensics, or divorce-related situations.
  • Abuse or misuse of services, including frequent missed appointments.
  • Online therapy considerations, including inadequate internet connectivity, frequent interruptions, etc.

It’s important to note that the counsellor does not engage in diagnosing illnesses, prescribing medications, or monitoring the client’s usage of them.

Client Conduct and Commitments

 

The client affirms that they have the legal capacity to consent to the counsellor’s services or have obtained the consent of a parent or guardian, and that they are legally capable of entering into a contract.

Clients should be mindful of the potential risks that may arise before committing to therapy, which include but not limited to, vulnerability, confrontations, change, emotional discomfort, slow therapeutic progress, etc.

Clients are responsible for covering all bank charges associated with payment transactions. The client acknowledges that all information provided through any electronic platform(s) throughout the term of the Contract for Service is accurate, complete and at their own risk.

The client agrees to indemnify, defend, and hold the counsellor harmless from any and all claims, losses, causes of action, demands, liabilities, costs, or expenses arising from breach or violation of any provisions within this Statement of Policies and Services. This indemnification clause remains in effect even after the termination of the Contract for Service.

Please note that the counsellor’s fees, services, and policies outlined in this Statement of Policies and Services may be amended by The Wisdom Waves without prior notice.
